This Liability Waiver, Release & Assumption of Risk Agreement ("Agreement") applies to participation in trips, golf tournaments, golf activities, fishing activities, boating activities, excursions, transportation, recreational activities, events, and other experiences organized, marketed, coordinated, facilitated, or provided by Trip Eighteen Golf LLC, doing business as Trip18 ("Trip18").

By signing or electronically accepting this Agreement, I acknowledge that I have read and understood its terms and voluntarily agree to be bound by them.

2. Voluntary Participation

I understand that participation in a Trip18 experience is voluntary.

Trip18 experiences may involve golf, tournament participation, transportation, international travel, fishing, boating, tours, excursions, outdoor recreation, dining, social events, and other activities.

I voluntarily choose to participate in the activities associated with my Trip18 experience.

3. Acknowledgment of Inherent Risks

I understand and acknowledge that travel, golf, fishing, boating, transportation, recreational activities, and international travel involve inherent and other risks that cannot be completely eliminated.

These risks may result in property damage, financial loss, illness, serious bodily injury, permanent disability, paralysis, or death.

I understand that risks may arise from my own actions or inactions, the actions or inactions of other participants, environmental conditions, equipment, facilities, transportation, third-party providers, or circumstances that cannot reasonably be anticipated or controlled.

4. Golf-Related Risks

I understand that golf and golf-related activities involve risks including, but not limited to:

• Being struck by golf balls

• Being struck by golf clubs

• Golf cart accidents

• Golf cart rollovers or collisions

• Slips, trips, and falls

• Uneven terrain

• Wet or slippery surfaces

• Water hazards

• Trees, branches, and natural obstacles

• Heat and sun exposure

• Lightning and severe weather

• Physical exertion

• Injuries caused by other golfers

• Equipment failure

• Wildlife and insects

• Course conditions

I voluntarily assume the inherent risks associated with playing golf, practicing, attending golf events, using golf facilities, and riding in or operating golf carts.

5. Fishing and Boating Risks

Some Trip18 experiences may include offshore fishing, sportfishing, boating, or other water-based activities.

I understand that these activities involve risks including:

• Rough seas

• Waves and changing ocean conditions

• Slippery surfaces

• Falling aboard a vessel

• Falling overboard

• Drowning

• Seasickness

• Fishing hooks

• Fishing lines

• Fishing equipment

• Fish and marine wildlife

• Boat movement

• Vessel collisions

• Equipment malfunction

• Weather changes

• Sun and heat exposure

• Distance from immediate medical assistance

• Emergency evacuation delays

I voluntarily assume the inherent risks associated with fishing, boating, and marine activities in which I choose to participate.

6. Transportation Risks

Trip18 experiences may involve transportation by:

• Cars

• Vans

• Buses

• Golf carts

• Boats

• Watercraft

• Taxis

• Rideshare vehicles

• Other forms of transportation

I understand that transportation carries inherent risks, including traffic accidents, collisions, road conditions, driver actions, mechanical failures, weather, and other circumstances.

I voluntarily assume the inherent risks associated with transportation used during my Trip18 experience.

7. Adventure and Recreational Activities

Trip18 experiences may include optional or included recreational activities such as:

• Hiking

• Swimming

• Boating

• Fishing

• Water activities

• Cultural excursions

• Nature activities

• Adventure activities

• Other destination experiences

I understand that each activity may involve risks unique to that activity.

I am responsible for determining whether I am willing and able to participate.

I may decline to participate in an optional activity if I do not wish to accept its risks.

8. International Travel Risks

I understand that international travel may involve risks different from those encountered in my home country.

These may include:

• Different road and transportation standards

• Different medical facilities

• Limited emergency medical services

• Language barriers

• Political or civil disturbances

• Crime

• Natural disasters

• Tropical weather

• Food- or water-related illness

• Infectious disease

• Wildlife

• Changes in governmental requirements

• Border or immigration issues

• Delayed emergency response

I voluntarily accept the ordinary and inherent risks associated with international travel.

9. Weather and Environmental Conditions

I understand that many Trip18 activities take place outdoors.

Weather and environmental conditions can change rapidly and may include:

• Extreme heat

• High humidity

• Heavy rain

• Strong winds

• Lightning

• Tropical storms

• Hurricanes

• Flooding

• Rough seas

• Earthquakes

• Volcanic activity

• Other natural conditions

I acknowledge that Trip18 cannot control weather or natural conditions.

10. Personal Health and Fitness

I am responsible for determining whether I am physically capable of participating in the activities I choose to undertake.

I understand that Trip18 does not provide medical advice or determine my fitness to participate.

If I have concerns about my ability to participate safely, I am responsible for obtaining appropriate professional advice before participating.

I agree not to participate in an activity when I know or reasonably should know that I am unable to do so safely.

11. Personal Responsibility

I agree to exercise reasonable care for my own safety and the safety of others.

I agree to:

• Follow reasonable safety instructions

• Follow golf course and tournament rules

• Follow boat captain and crew instructions

• Follow transportation safety requirements

• Use required safety equipment

• Follow instructions provided by activity operators

• Avoid reckless or dangerous conduct

• Refrain from participating when impaired by alcohol, drugs, medication, illness, or another condition that makes participation unsafe

I understand that failure to follow safety instructions may result in my removal from an activity.

12. Alcohol

Some Trip18 experiences may include events where alcoholic beverages are available.

I understand that consuming alcohol may impair judgment, coordination, reaction time, and physical ability.

I accept responsibility for my own alcohol consumption and agree not to operate a vehicle, golf cart, boat, or other equipment while impaired.

13. Independent Suppliers

I understand that many components of a Trip18 experience may be provided by independent third parties.

These may include:

• Hotels and resorts

• Golf courses

• Golf clubs

• Tournament organizers

• Fishing lodges

• Boat owners and operators

• Captains and crews

• Transportation companies

• Drivers

• Destination management companies

• Tour operators

• Restaurants

• Excursion providers

• Activity operators

• Other travel suppliers

These businesses may be independently owned and operated and may maintain their own rules, waivers, insurance, safety procedures, and terms.

I understand that I may be required to sign additional waivers or agreements directly with individual activity providers.

14. Assumption of Risk

I KNOWINGLY AND VOLUNTARILY ASSUME THE INHERENT RISKS ASSOCIATED WITH MY PARTICIPATION IN THE TRIP18 EXPERIENCE AND THE ACTIVITIES I CHOOSE TO UNDERTAKE.

I understand that not every risk can be identified in advance and that unexpected events may occur.

My decision to participate is voluntary.

15. Release and Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I release and discharge Trip Eighteen Golf LLC, doing business as Trip18, together with its members, managers, officers, employees, representatives, agents, and contractors acting within the scope of their relationship with Trip18 (collectively, the "Released Parties"), from claims arising from the ordinary and inherent risks of activities covered by this Agreement.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, this release is also intended to apply to claims arising from the ordinary negligence of a Released Party in connection with the activities covered by this Agreement.

This Agreement does not release claims that cannot legally be waived, including liability to the extent arising from conduct for which a waiver is prohibited by applicable law.

16. Independent Supplier Liability

To the fullest extent permitted by law, Trip18 is not responsible for the independent acts or omissions of separately owned and operated Suppliers.

Nothing in this Agreement is intended to release an independent Supplier from liability where such liability cannot legally be waived.

I understand that claims involving an independent Supplier may be governed by that Supplier's own agreement, applicable law, or both.

17. Medical Treatment and Emergency Assistance

If I become injured or ill and am unable to provide instructions, I authorize Trip18 personnel to contact emergency services and provide my emergency contact information when reasonably necessary.

I understand that Trip18 personnel are not medical professionals and are not responsible for providing medical treatment.

I understand that emergency assistance may involve:

• Ambulance transportation

• Hospital treatment

• Medical evacuation

• Air transportation

• Emergency lodging

• Other medical or logistical services

I am financially responsible for medical treatment, evacuation, transportation, and other emergency expenses incurred on my behalf except to the extent another party is legally responsible.

18. Travel and Medical Insurance

I understand that Trip18 strongly recommends comprehensive travel insurance, including appropriate medical and emergency evacuation coverage.

I understand that my domestic health insurance may provide limited or no coverage outside my home country.

I am responsible for determining whether I have adequate insurance.

My decision to purchase or decline insurance does not alter the risks associated with participation.

19. Personal Property

I am responsible for my personal property, including:

• Golf clubs

• Golf equipment

• Luggage

• Electronics

• Passports

• Money

• Jewelry

• Fishing equipment

• Other personal belongings

To the fullest extent permitted by law, Trip18 is not responsible for loss, theft, or damage to personal property except to the extent directly caused by Trip18 and for which liability cannot legally be excluded.

20. Compliance with Local Laws and Rules

I agree to comply with applicable laws, regulations, safety requirements, golf course rules, tournament rules, hotel policies, vessel rules, and reasonable instructions from activity providers.

I understand that failure to comply may result in removal from an activity or Trip18 experience without refund where permitted under the applicable booking terms.

21. Indemnification

To the extent permitted by applicable law, I agree to indemnify and hold harmless the Released Parties from third-party claims, liabilities, damages, and reasonable costs arising from:

• My intentional misconduct

• My unlawful conduct

• My material violation of safety instructions

• Property damage caused by my negligent or intentional actions

• Injury I negligently or intentionally cause to another person

This provision does not require me to indemnify a Released Party for liability that applicable law prohibits from being shifted to me.

22. No Guarantee of Safety

I understand that Trip18 and its Suppliers may take reasonable precautions intended to promote participant safety, but no activity or travel experience can be made completely risk-free.

I acknowledge that safety precautions cannot eliminate every potential hazard.

23. Voluntary Withdrawal From an Activity

If I believe an activity presents a risk I am unwilling to accept, I may decline to participate or discontinue participation when reasonably possible.

I understand that voluntarily declining or discontinuing an activity does not automatically entitle me to a refund.

Refund eligibility is governed by the applicable Trip18 Cancellation & Refund Policy and booking terms.

24. Governing Law

To the extent permitted by applicable law, this Agreement will be governed by the laws of the State of Utah, without regard to conflict-of-law principles.

Any mandatory rights or laws applicable to activities occurring in another jurisdiction remain applicable where they cannot legally be waived.

25. Dispute Resolution and Venue

Before commencing formal legal proceedings, the participant and Trip18 agree to make a reasonable good-faith effort to resolve the dispute directly.

To the extent permitted by applicable law, any legal proceeding arising from this Agreement involving Trip18 will be brought in a court of competent jurisdiction in Utah unless applicable law requires another jurisdiction or venue.

26. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

27. Electronic Acceptance and Signature

I understand that this Agreement may be presented and accepted electronically.

I agree that my electronic signature, electronic acceptance, or other legally recognized electronic execution of this Agreement is intended to have the same effect as my handwritten signature to the extent permitted by applicable law.

Trip18 may retain an electronic record of my acceptance, including the date and time of acceptance and other transaction information.

28. Entire Agreement Regarding Risk and Release

This Agreement constitutes the agreement between me and Trip18 regarding the assumption of risk, release, and waiver addressed in this document.

It should be read together with the applicable:

• Trip18 Terms & Conditions

• Travel & Booking Policy

• Cancellation & Refund Policy

• Travel Insurance Policy & Disclaimer

If a particular activity requires a separate Supplier waiver, that waiver may apply independently in addition to this Agreement.

29. Acknowledgment

BY SIGNING OR ELECTRONICALLY ACCEPTING THIS AGREEMENT, I ACKNOWLEDGE THAT:

• I have read this Agreement carefully.

• I understand the nature of the activities in which I may participate.

• I understand that travel and recreational activities involve inherent risks.

• I voluntarily assume the inherent risks described in this Agreement.

• I understand that this Agreement contains a release and waiver of certain legal rights.

• I understand that the release may include claims based on ordinary negligence to the extent permitted by applicable law.

• I have had the opportunity to ask questions before accepting this Agreement.

• I am entering into this Agreement voluntarily.

Electronic Acceptance

When this Agreement is completed electronically, the participant's electronic acceptance or signature and the associated electronic record may serve as evidence of acceptance.
